TERMS & CONDITIONS OF SALE

Dravin India Private Limited (“Dravin”, “we”, “our”, “us”) is a company incorporated under the Companies Act, 2013 and engaged in wholesale and retail sale of goods across India (“Products” and related “Services”).

All orders placed through www.dravin.in (“Website”) are sold and fulfilled by Dravin, including invoicing, payment processing, delivery, returns/exchanges, and after-sales support (where applicable).

By accessing or purchasing through the Website, you agree to these Terms & Conditions (“Terms”).

1. TERMS

1.1 These Terms govern the sale and purchase of Products between Dravin and the customer (“you”, “your”). Dravin may revise these Terms from time to time to comply with legal or business requirements (“Revised Terms”). You are responsible for reviewing the Terms periodically.

1.2 Product descriptions, images, specifications and pricing shown on the Website are provided for convenience and may vary slightly from the actual Product (including packaging). Dravin does not guarantee that all Product information will be error-free at all times.

1.3 The Product listings on the Website constitute an invitation to offer. Your order constitutes an offer to purchase. Dravin accepts your order only when the Product is dispatched. Any order confirmation message/email/SMS does not amount to acceptance.

1.4 Persons who are “incompetent to contract” under the Indian Contract Act, 1872 (including minors and undischarged insolvents) are not eligible to purchase Products through the Website. Users under 18 years may browse but cannot place orders.

2. SERVICES; ORDER, PRICING & PAYMENT

2.1 Services

Dravin provides the following Services in connection with your purchase:
(a) Supplying the Product ordered by you.
(b) Arranging shipment and delivery through authorised logistics partners (“Logistics Supplier”).
(c) Customer support via contact@dravin.in.

2.2 Pricing & Payment

2.2.1 Prices displayed on the Website are in INR and are inclusive/exclusive of applicable taxes as shown at checkout. Shipping/handling charges (if any) will be shown before you place the order.

2.2.2 Dravin may refuse or cancel an order in the following cases:
(a) Product is out of stock or unavailable.
(b) Payment authorisation fails or is declined.
(c) Incorrect pricing or Product information is displayed due to error.
(d) Delivery is not available to the provided address due to restrictions.
(e) Dravin suspects fraudulent, suspicious, or unauthorised transactions.
(f) Any other reason at Dravin’s discretion, subject to applicable law.

2.2.3 If a pricing or listing error occurs, Dravin may cancel the order and refund the paid amount, or contact you for confirmation before processing.

2.2.4 Dravin is not responsible for payment failures caused by bank issues, card limits, payment gateway errors, or other technical issues beyond Dravin’s control.

2.2.5 All payment instruments are subject to verification/validation by the issuing bank/payment provider. If validation fails, Dravin may cancel the order.

2.2.6 For Cash on Delivery (“COD”) orders, Dravin may conduct additional verification checks and may cancel the order if verification is unsuccessful.

2.2.7 You agree to provide accurate billing and contact information. Providing false, incomplete, or misleading information may result in cancellation of the order and may be treated as a breach of these Terms.

2.2.8 Dravin reserves the right to limit the quantity/value of Products purchased per customer, household, or order.

3. SHIPPING & DELIVERY

3.1 You are responsible for providing complete and accurate delivery details.

3.2 Delivery timelines are estimates and may vary due to logistics, weather, regulatory restrictions, or other circumstances beyond Dravin’s control.

3.3 Risk of loss and title in the Products pass to you upon successful delivery by the Logistics Supplier at the delivery address provided by you.

3.4 Dravin is not responsible for delivery failures or delays caused due to incorrect/incomplete address details or unavailability of the recipient at the delivery location.

3.5 If you receive a damaged, defective, incorrect, or missing Product, you must contact contact@dravin.in within the time period mentioned in the Returns Policy to initiate resolution.

4. RETURNS, REFUNDS & EXCHANGES

4.1 Returns and exchanges are governed by the Returns Policy & Returns Process available on the Website.

4.2 To be eligible for return, Products must be unused, in original condition, in original packaging with all tags/labels intact, and accompanied by the original invoice (as applicable).

4.3 Certain Products may be non-returnable or non-exchangeable as mentioned in the Returns Policy.

4.4 Refunds will be processed after successful inspection and approval as per the Returns Policy.

4.5 Refund timelines depend on banks/payment providers and may take up to 15 business days. Dravin is not liable for delays caused by financial institutions.

5. LIMITATION OF LIABILITY & INDEMNITY

5.1 To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Dravin, its directors, employees, officers, agents, affiliates, contractors, and licensors from any claims, losses, liabilities, damages, costs or expenses arising from:
(a) your breach of these Terms, or
(b) misuse of the Website, or
(c) violation of applicable laws.

5.2 To the maximum extent permitted by law, Dravin shall not be liable for any indirect, incidental, special, or consequential damages including loss of profits, data loss, goodwill, business interruption, or system failure.

5.3 In any event, Dravin’s total liability (if any) shall not exceed the amount paid by you for the Product giving rise to the claim.

6. GENERAL

6.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable.

6.2 These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts at kolkata, westbengal

6.3 No partnership, employment, agency, or joint venture relationship is created between you and Dravin by use of the Website.

6.4 References to “Website” include www.dravin.in and any successor domain(s) operated by Dravin.

6.5 These Terms constitute the entire agreement between you and Dravin regarding the purchase of Products through the Website and supersede all prior communications. You may not assign or transfer your rights under these Terms without Dravin’s written consent.

6.6 Dravin shall not be liable for delay or failure in performance due to events beyond its reasonable control, including natural disasters, war, riots, pandemics, internet outages, cyberattacks, transport disruptions, or other force majeure events.
